The Council of Mayors of the Association of Kosovo Municipalities (AKK) has decided to submit the Government’s Regulation on the Recruitment Procedure in the Civil Service to the Constitutional Court for review of its constitutionality.
According to AKK, municipalities will not allow any violation of local self-governance, stating that the right to local self-government is a constitutional category and is guaranteed by the Constitution of Kosovo, applicable laws, and the European Charter of Local Self-Government.
“Municipalities exercise their own, extended, and delegated competencies through representative bodies and in accordance with the principles of decentralization and subsidiarity. The central government has the right to exercise only legality control over municipal acts, but not to interfere in the constitutional and autonomous competencies of municipalities. Any action that exceeds this limit constitutes a violation of the constitutional order and local autonomy.
In this spirit, the Association of Kosovo Municipalities considers that Government Regulation No. 07/2025 on the Recruitment Procedure in the Civil Service represents a direct interference in the competencies of municipalities, centralizing procedures for recruiting municipal staff and reducing the functional autonomy of local government,” the AKK statement says, as reported by KosovaPress.
Furthermore, AKK said such an approach by the government is contrary to the Constitution of Kosovo, the principle of subsidiarity, and European standards of local governance.
“For this reason, AKK, through the municipalities, will submit this Government Regulation to the Constitutional Court, with a request for an assessment of its constitutionality, in order to protect local autonomy and the constitutional order in the Republic of Kosovo,” the statement concludes.
