24 years without a decision, the Constitutional Court finds a violation

The Constitutional Court of the Republic of Kosovo has published its judgment in the case submitted by Adem Shehu, finding a violation of the right to a trial within a reasonable time.

In a unanimous decision, the Court assessed that the judicial proceedings related to case [T.nr.29/2000] at the Basic Court in Gjakova were unjustifiably prolonged, thereby violating Article 31 of the Constitution and Article 6 of the European Convention on Human Rights.

The case concerns inheritance proceedings initiated by the applicant on November 7, 2000, regarding property left by his mother. The proceedings were suspended in 2002 and, according to the Constitutional Court, have remained unresolved for more than 24 years, without any final outcome.

The Court found that the applicant did not contribute to the delays in the proceedings and that responsibility for the prolongation lies with the judicial authorities. According to the judgment, such a lengthy delay is unjustifiable and contrary to constitutional and European standards for a fair trial.

As a result, the Constitutional Court ordered the Basic Court in Gjakova to undertake all necessary procedural actions to continue and conclude the case, and to inform the Constitutional Court by March 11, 2026, of the measures taken to implement the judgment.
