Lawsuit filed against the Municipality of Pristina over illegal parking regulation

The Group for Legal and Political Studies (GLPS) has filed a lawsuit for the annulment of the regulation for the organization and use of parking spaces in the Municipality of Pristina.

In a press conference, the coordinator of the judicial affairs center, Liridon Salihu, stated that they expect the Supreme Court to decide on the legality of the Pristina Parking regulation. After analyzing the regulation, GLPS argued that some provisions contradict existing laws and are incomplete in their content.

"The Center for Strategic Judicial Cases, a platform of the Group for Legal and Political Studies, today has filed a lawsuit with the Supreme Court of Kosovo against the Municipality of Pristina. With this lawsuit, we have requested that the Supreme Court decide on the legality of the Pristina Parking regulation. This regulation, which came into force on January 22, 2024, and on April 5, 2024, GLPS, after analyzing this sub-legal act, assessed that there are provisions that contradict the existing laws, and the regulation is also incomplete in terms of its content. All of these claims have been made through a request addressed to the Mayor of Pristina, Përparim Rama, and the members of the Municipal Assembly of Pristina, asking them to address these issues and initiate the procedure for amending and supplementing the regulation. Since neither the municipality nor the mayor, Përparim Rama, showed the will to initiate the procedure for amending the regulation and addressing all the shortcomings, today we are filing the lawsuit in the Supreme Court," he said.

GLPS has requested that the Supreme Court annul the regulation entirely, and then it will be seen if the Municipality will reflect and make the necessary changes. Salihu also emphasized that before this regulation came into force, the Ministry of Justice had asked the Municipality of Pristina to review the regulation, but as he stated, the municipality remained silent and did not consider it.

He mentioned that they have attached the latest report from the National Audit Office to the lawsuit, a report that highlights that the drafting of this regulation was not done based on a thorough analysis.
