Exclusive: Court imposes security measure against ERO decision

For the first time in Kosovo, a business has succeeded in obtaining a security measure against a notification issued by the Energy Regulatory Office (ERO) concerning the liberalization of the electricity market.

The decision was issued by the Commercial Court of Kosovo, Administrative Affairs Department, on June 19, 2025.KEK

The complaint to the court was filed by lawyer Agron Selimaj from Prishtina.

KosovaPress has obtained the court’s ruling, which states that, according to the decision dated June 19, 2025, the Commercial Court, Administrative Affairs Department, approved the plaintiff's request by granting a security measure to postpone the execution of ERO’s notification dated 03.06.2025. This notification had prohibited the plaintiff from using the universal supply service.

The court ruled that the execution of this notification be suspended until a final judicial decision is reached.

In addition to this case, the Kosovo Chamber of Commerce and Industry (KCCI), the Kosovo Chamber of Commerce, and several other businesses have also filed objections against ERO’s decision.

It is worth recalling that the Energy Regulatory Office had announced through a press release that its board had appointed the legal entity KEK as the Supplier of Last Resort for a six-month period, from August 31, 2025, to January 31, 2026.

ERO has extended the deadline for signing contracts following protests by Kosovo businesses that opposed the liberalization of the energy market, KosovaPress reports.

Businesses in Kosovo had organized a protest against ERO’s decision, claiming that such a move would place a heavy burden on Kosovo’s economy.

The board’s review also included consumer complaints and other issues related to the functioning of the Energy Regulatory Office.
