The President of the country, Vjosa Osmani, will send her comments tomorrow to the Constitutional Court regarding the issue of the convening of the Assembly, confirmed to KosovaPress by her media advisor, Bekim Kupina.
“As you know, the Constitutional Court has already issued a temporary measure until September 30. Regarding the merits of the case, the President will submit her comments on the matter to the Constitutional Court within the deadline set by the Court, that is, tomorrow, September 9,” said Kupina.
In response to KosovaPress on Monday, he said that “the President’s position has always been that no one should have the right to block institutions, and consequently the state. As provided in Article 57 (4) of the Constitution, the exercise of community rights is inseparable from the obligation to respect the laws of the Republic of Kosovo and not to infringe upon the rights of others.”
The Constitutional Court has issued a temporary measure prohibiting any action by Members of the Assembly as well as the initiation of any procedure for the formation of a new government.
The Court’s measure—which came after a complaint by the Serbian List—was made public last week and will remain in effect until September 30.
The constitutive session of the Assembly of Kosovo was concluded on August 30 by the Speaker, Dimal Basha, although the deputies failed to elect the deputy speaker from the Serbian community alongside the election of the speaker and the other four deputy speakers of the legislature.
In his reasoning, Basha said that he took this action to prevent the state from being blocked and to allow the Assembly to continue functioning, and consequently to form the government after the parliamentary elections.
The Serbian List addressed the Constitutional Court on August 30, after the newly elected Speaker of the Assembly, Dimal Basha, decided that the election of the two deputy speakers from non-majority communities should be held separately and not in a package, as had been the previous practice.
Thus, from the non-Serb communities, Emilja Rexhepi was elected deputy speaker, while ten deputies from the Serbian community, including Nenad Rashiq, failed to secure the 61 votes required to obtain this post.
