Hearing in the Nagip Krasniqi case cancelled due to the promotion of the presiding judge

The court hearing against the former Chief Executive Officer of the Kosovo Energy Corporation (KEK), Nagip Krasniqi, who is charged with the criminal offense of “Abuse of official position or authority,” which was scheduled for today at 09:30, has been cancelled. This is due to the promotion of the presiding judge, Arben Hoti, to the Court of Appeal.

The cancellation of the hearing was confirmed to KosovaPress by the Information Officer of the Basic Court of Prishtina, Mirlinda Gashi, who stated that a new judge will soon be appointed for this case.

“Referring to your request for information, we inform you that the court has cancelled the hearing scheduled for 12.01.2026 in the criminal case against the defendant N.K., due to the promotion of the presiding judge – Judge Arben Hoti – to the Court of Appeal of Kosovo. In this regard, the case in question will soon be assigned to a new presiding judge, after which the scheduling of a court hearing will proceed, and you will be informed in due time,” Gashi stated in her response to KosovaPress.

According to the indictment, Krasniqi, in his capacity as CEO of KEK, starting from October 15, 2021 and onward, with the intent to enable the economic operator “Holding Slovenske Elektrarne” (HSE) from Slovenia to trade electricity in the Republic of Kosovo in violation of the Law on Electricity and the Law on the Energy Regulator, knowingly approved purchases, signed contracts, authorized their signing, and confirmed the continuation of trading with the said operator, despite being aware that electricity could not be traded with this operator until it was licensed or its license was recognized by the Energy Regulatory Office (ERO).

The indictment states that the operator was enabled to gain unlawful financial benefit and to evade tax payments in the Republic of Kosovo, resulting in significant damage to Kosovo’s budget in the amount of €531,920.79. It further states that this action harmed and discriminated against other competing economic operators operating in the Kosovo market that were licensed and subject to tax obligations.

Meanwhile, the material damage to KEK is said to be substantial, namely €3,229,905.00.

In this case, the Special Prosecution filed the indictment on 19.08.2024 against the former CEO of the Kosovo Energy Corporation, Nagip Krasniqi, for the criminal offense of abuse of official position or authority.

Krasniqi was arrested on 19.04.2023 on suspicion of abuse of official position, exerting influence, and conflict of interest.

He remained in pre-trial detention from 20.04.2023, but was released five months later, on 15.09.2023.

Krasniqi’s arrest was carried out by order of the Special Prosecution of the Republic of Kosovo.
