Full Constitutional Court ruling on the Assembly published

The Constitutional Court of Kosovo today (Monday) published the full judgment regarding the blockade in the Assembly.

The temporary measure remained in force until the judgment was published and appeared in the Official Gazette.

On August 8, the Constitutional Court stated that deputies must elect the Speaker of the Assembly through an open vote. The court also ruled that a candidacy for Speaker can be voted on only three times. The Court emphasized that the constitution of the Assembly must be completed within 30 days.

“The Court ruled: TO ORDER, by 6 [six] votes in favor and 1 [one] against, the Chair of the Constitutive Session of the Assembly of the Republic of Kosovo to proceed with item 3 of the agenda of the Constitutive Session, approved on April 8, 2025, and in accordance with paragraph 2 of Article 67 [Election of the Chair and Deputy Chairs] of the Constitution of the Republic of Kosovo, to invite the representative of the largest parliamentary group to propose the candidate(s) for Speaker of the Assembly of the Republic of Kosovo, who shall be elected through an open vote, a vote which may be held only up to 3 (three) times for the same candidate,” reads the Constitutional Court’s ruling published today.

The Constitutional Court stated that the deputies elected to the Assembly of Kosovo did not comply with the June 26, 2025 Judgment and, “consequently, all sessions held from June 27 to July 26, 2025, are declared null and void.”

Additionally, the court said that “the Chair of the Constitutive Session of the Assembly of the Republic of Kosovo did not act in accordance with the Judgment of the Constitutional Court of the Republic of Kosovo in case KO124/25 of June 26, 2025, and consequently, his actions are in conflict with paragraph 1 of Article 116 [Legal Effect of Decisions] of the Constitution of the Republic of Kosovo.”
