The candidate proposed by the Vetëvendosje Movement for Speaker of the Assembly of Kosovo, Albulena Haxhiu, does not have the right to run again after several failed attempts to be elected to this position.
This is the assessment of the researcher at the Kosovo Institute of Justice, Gëzim Shala, according to whom, with the publication of the full judgment on the political deadlock, the Constitutional Court has not created new norms, but has only clarified the meaning of existing norms.
On Monday, the Constitutional Court published the full judgment regarding the political deadlock in the country.
According to this judgment, within 30 days the constitutive session of the Assembly of Kosovo must take place, and the name of the proposed candidate for Speaker of the Assembly cannot be voted on more than three times.
Shala emphasizes that the re-nomination of the same candidate is proof of attempts to delay the constitution of the Assembly of Kosovo.
“In relation to Ms. Haxhiu’s candidacy, the Constitutional Court has not created any new norm, it has only clarified the meaning of the existing ones. For this reason, since the voting of the same candidate has already failed several times, she is now considered no longer eligible to run again for Speaker of the Assembly. Moreover, even if it were considered that she had the right, it is clear that, just as in the previous attempts, this candidate does not have the necessary votes in the Assembly of Kosovo. For this reason, the re-nomination of the same candidate is clearly evidence of efforts to delay the constitution of the Assembly of Kosovo. The judgment of the Constitutional Court is equivalent to the constitutional norm. Therefore, for this reason, we do not want to believe that there will be attempts to sabotage the judgment of the Constitutional Court, respectively its decision,” he said.
Gëzim Shala from IKD also explained how tomorrow’s constitutive session is expected to proceed.
“In line with the Constitutional Court’s judgment, during tomorrow’s session the presiding member must return to the agenda by inviting the representatives of the first party, namely Vetëvendosje, to propose their candidate for Speaker of the Assembly. According to the Constitutional Court’s judgment, the same candidate cannot be proposed more than three times,” said Shala.
Meanwhile, the deputies of the Assembly of Kosovo will gather today to continue the constitutive session. The Vetëvendosje Movement has criticized both this judgment and the Constitutional Court itself, while the other two political parties – the Democratic Party of Kosovo (PDK) and the Democratic League of Kosovo (LDK) – believe that this judgment paves the way for unblocking the political situation.
