Did the Commercial Court suspend the ERO’s decision on energy market liberalization?

The Commercial Court of Kosovo is reported to have suspended the decision of the Energy Regulatory Office (ERO), which foresees the exit of businesses to the liberalized electricity market.

The suspension measure will apply until the Court makes a final decision on this matter.

However, there is still no official response for ​KosovaPress from the Energy Regulatory Office (ERO) regarding this decision, whether it will entirely cancel the notification dated March 12, 2025, through which companies were informed about the mandatory transition to the open electricity market.

KosovaPress has also requested clarifications for this decision from the Commercial Court, which until the publication of this article has not returned a response.

Lawyer Blinera Osmani wrote on Facebook that on July 29, 2025, the Commercial Court of Kosovo, Chambers of First Instance, through Judgment KA.nr.301/25, has made a clear and binding decision, by:
Cancelling point IV of ERO’s Decision no.275/24, dated 05.04.2024;
Completely cancelling the Notification of ERO dated 12.03.2025 for entry into the free market, as unlawful;
Completely suspending the implementation of all these decisions until a final decision of the court;
This means that for all consumers the decision for entry into the free market can no longer be implemented;
And they must immediately return to the universal market, with secure supply and with regulated tariffs, as they were before June 1, 2025.

Yesterday afternoon, according to internal sources of KosovaPress within the Energy Regulatory Office (ERO), this decision of the Commercial Court published by lawyer Blinera Osmani, does not repeal the entire decision of the Regulator for the exit of businesses into the open market. According to our sources in ERO, this decision is for an individual (business) case, which is not general.

After the decision of the Commercial Court, the Kosovo Chamber of Commerce has called on ERO to cancel the notification for the transition to the free energy market.

Also, the American Chamber of Commerce in Kosovo has reacted after today’s decision of the Department for Administrative Issues of the Commercial Court, for the suspension of the notification of the Energy Regulatory Office (ERO) on the liberalization of the energy market, as well as the setting of the security measure, awaiting the final judgment, the American Chamber of Commerce in Kosovo repeats its call for ERO to immediately repeal its contested decision for the liberalization of the energy market.

Meanwhile, yesterday the member businesses of the Chamber of Commerce and Industry of Kosovo have warned of harsh actions if ERO does not withdraw from the decision for the liberalization of the energy market.

On the other hand, about 1,300 businesses with over 50 workers or with annual turnover over 10 million euros have been warned by ERO, KEK and KEDS that they will be disconnected from the network starting today if they have not secured contracts with suppliers in the open electricity market.
