PDK asks the Constitutional Court to evaluate the Law on the Sovereign Fund

The Democratic Party of Kosovo has sent the Law on the Sovereign Fund to the Constitutional Court for evaluation.

Meanwhile, the lawyer Faton Fetahu said that the MPs of the Parliamentary Group of the PDK have warned from the beginning that such an initiative is unconstitutional, as some enterprises will be subjected to this enterprise, thus creating legal and economic inequality.

PDK MP Ferat Shala said that the Government is trying to use such discriminatory and unequal laws to capture the resources, assets and enterprises that, de facto and de jure, manages itself.

Shala emphasized that the management team of the Sovereign Fund, on the basis of the foreseen regulations, will regulate the fate of thousands of workers of the fallen industry, Trepca, KEK, PTK and railways, which according to him, will leave thousands of workers without no legal care.

Meanwhile, PDK’s lawyer, Faton Fetahu, said that 11 articles of this law are incompatible with at least 7 articles of the Constitution, and this is also the article that talks about the investment role of the Sovereign Fund. He said that the Government in this way it creates a monopoly in the market, because the Sovereign Fund will choose two private companies according to its wish, it will invest without conditions and without criteria, and in relation to this there will be discrimination.

This Law was approved days ago in the Assembly of Kosovo, with the votes of the MPs of the party in power.
