The Special Prosecution of the Republic of Kosovo, following the developments of the investigation, has today filed an indictment at the Basic Court in Pristina, against the defendant with the initials C.K, of Serbian nationality, on suspicion of having committed the criminal offense, “Crime of war against the civilian population”, sanctioned by Article 142, in conjunction with Article 22 of the SFRY.
According to the prosecution, the investigations have established that during the period of the war in Kosovo during 1998-1999, the defendant committed sexual violence as a war crime against a victim of Albanian nationality.
“In accordance with Articles 234 par.2 and 303 par. 7 of the CPC, the Special Prosecution has proposed to the Court to hold the trial in absentia because the defendant C.K. is inaccessible to the justice authorities, while the legal conditions under Article 234 of the CPC for filing an indictment in absentia have been met. This criminal case has now been transferred to the jurisdiction of the Special Department of the Basic Court in Pristina for further proceedings,” the statement said.
