Public criticism between the Ministry of Justice (MoJ) and the Judicial and Prosecution Council lowers public confidence and the belief that these institutions have a common interest in addressing justice reform.
This is what the director of the Kosovo Law Institute (KLI), Ehat Miftaraj, said during the publication of the KLI report on “Problems of reform in justice”, which was like an analysis of the four draft laws that emerge from the “Joint Declaration of Commitments”.
Miftaraj said that Kosovo and the European Union have a contractual relationship which obliges our institutions to have a cooperation based on good faith with the judicial and prosecutorial councils for basic policies related to justice reforms.
Meanwhile, Melosh Kolshi, researcher at KLI, said that the members of the Councils who are mandated to evaluate the performance of judges and prosecutors cannot be subject to performance evaluation in their capacity as members of the Councils.
However, as regards the draft law for supplementing and amending the law on the KPC, Kolshi has stated that the KLI assesses that the MoJ is developing two separate procedures in this regard.
According to the KLI, the MoJ should review and review legislative planning and management processes to ensure that legislative initiatives are well coordinated.
