{"id":76040,"date":"2025-08-08T16:00:22","date_gmt":"2025-08-08T16:00:22","guid":{"rendered":"https:\/\/kosovapress.com\/eng\/admin\/?p=76040"},"modified":"2025-08-08T16:00:27","modified_gmt":"2025-08-08T16:00:27","slug":"besian-mustafa-the-constitutional-courts-ruling-is-final-vv-aimed-to-capture-institutions","status":"publish","type":"post","link":"https:\/\/kosovapress.com\/eng\/admin\/besian-mustafa-the-constitutional-courts-ruling-is-final-vv-aimed-to-capture-institutions\/","title":{"rendered":"Besian Mustafa: The Constitutional Court\u2019s ruling is final, VV aimed to capture institutions"},"content":{"rendered":"\n<h2>The Democratic League of Kosovo (LDK) held a press conference today, just hours after the Constitutional Court\u2019s decision regarding the steps that should be taken to overcome the political deadlock caused by the failure to elect the new speaker of the ninth legislature.<\/h2>\n\n\n\n<p>LDK MP Besian Mustafa described the Constitutional Court\u2019s ruling as clear and final, and stated that Vet\u00ebvendosje (VV) has violated the constitution.<\/p>\n\n\n\n<p>He said this was not a procedural mistake by Vet\u00ebvendosje, but a deliberate attempt to capture the country\u2019s highest institution \u2014 the Assembly of Kosovo \u2014 through unlawful actions, KosovaPress reports.<\/p>\n\n\n\n<p>Mustafa said the LDK welcomes the Constitutional Court\u2019s ruling and reaffirmed their stance as guarantors of constitutional order.<\/p>\n\n\n\n<p>MP Besian Mustafa added that VV must end its unconstitutional approach and gain power by respecting the rules, not by breaking them. He also noted that VV MPs today attacked the Constitutional Court and its judges, calling this unacceptable in a democratic republic with a genuine constitutional order.<\/p>\n\n\n\n<p>The Constitutional Court today stated that MPs must elect the Speaker of the Assembly through an open vote. It also ruled that the same candidacy for Speaker can only be voted on three times.<\/p>\n\n\n\n<p>The Court decided that the constitution of the ninth legislature must be completed within 30 days, and that all MPs must be present and vote during the procedure for electing the Speaker and Deputy Speakers of the Assembly.<\/p>\n\n\n\n<p>In today\u2019s decision, the Constitutional Court said that elected MPs failed to implement the Judgment of 26 June 2025, and therefore all sessions held from 27 June to 26 July 2025 are declared invalid.<\/p>\n\n\n\n<p>The Court also said that the chairperson of the constitutive session, Avni Dehari, did not act in accordance with the Court\u2019s judgment in case KO124\/25 of 26 June 2025, and that his actions were therefore inconsistent with the highest legal act of the country.<\/p>\n\n\n\n<p>As the party that came first in the 9 February elections, in coalition with Guxo, and Alternativa, VV has so far nominated Albulena Haxhiu for Speaker of the Assembly, but she has failed six times in open voting to secure the required 61 votes.<\/p>\n\n\n\n<p>Afterward, VV, Guxo, and Alternativa insisted that the Speaker be elected by secret ballot, but this was opposed by PDK, LDK, AAK, and NISMA.<\/p>\n\n\n\n<p>On 24 July, the Constitutional Court imposed an interim measure stipulating that MPs could not take any decisions or actions related to constituting the ninth legislature until 8 August 2025.<\/p>\n\n\n\n<p>This came after the Court considered the requests from the Democratic Party of Kosovo and the Democratic League of Kosovo regarding the formation of the ninth legislature.<\/p>\n\n\n\n<p>The Constitutional Court had earlier issued a judgment on the Assembly matter, stating that the legislative body had to be constituted within 30 days. MPs ignored this ruling, and the Court itself did not initially specify the consequences for non-compliance.<\/p>\n\n\n\n<p>Kosovo is facing a deep political crisis due to the failure to form new institutions.
