In at least two separate cases, the Commercial Court of Kosovo ruled in favor of individual companies contesting ZRRE\u2019s decisions, thus suspending their enforcement pending a final verdict, as reported by&nbsp;<a href=\"https:\/\/kosovapress.com\/\">KosovaPress<\/a>.<\/p>\n\n\n\n<p>According to AECK, what is particularly important is that two different judges, in separate cases, reached the same conclusion: suspending the ZRRE decisions while awaiting final judgments.<\/p>\n\n\n\n<p><em>\u201cThis consistent judicial approach reflects concerns about the potential impact of these decisions on the market and therefore cannot be dismissed as coincidental or specific to one or two cases,\u201d<\/em>&nbsp;the statement said.<\/p>\n\n\n\n<p>According to AECK, although these rulings currently apply to a limited number of companies, their implications extend much further. Continuing to implement the liberalization measures by ZRRE\u2014while two companies currently benefit from court-ordered suspensions and others remain pending judicial decisions or legal procedures\u2014creates an environment of legal uncertainty and economic discrimination.<\/p>\n\n\n\n<p>The American Chamber strongly believes that reforms, including those in the energy sector, must be guided by the principles of justice, predictability, and equal treatment under the law. Under these circumstances, the American Chamber of Commerce in Kosovo calls on the Energy Regulatory Office to immediately suspend the contested liberalization measures until the judiciary provides clarity through final decisions on all relevant complaints.<\/p>\n\n\n\n<p><em>\u201cOnly a fair, transparent, and fully functional market can offer a sustainable path forward, where all companies, regardless of size or legal capacity, operate under equal conditions,\u201d<\/em>&nbsp;the statement said.<\/p>\n\n\n\n<p>The Kosovo Chamber of Commerce (OEK) announced a second court ruling within two days, which cancels the notice issued by the Energy Regulatory Office (ZRRE) regarding the entry into the liberalized energy market.<\/p>\n\n\n\n<p>According to OEK, this development clearly shows that businesses were right to raise their voices against the injustices of the ZRRE, as reported by&nbsp;<a href=\"https:\/\/kosovapress.com\/\">\u200bKosovaPress<\/a>.<\/p>\n\n\n\n<p>On Tuesday, the Kosovo Chamber of Trade and Industry (DHTIK) announced that the Commercial Court in Prishtina had issued a decision suspending the ZRRE notice related to the mandatory entry of businesses into the liberalized electricity market.<\/p>\n\n\n\n<p>The court complaint was filed by attorney Agron Selimaj from Prishtina.<\/p>\n\n\n\n<p>KosovaPress obtained the court ruling, which states that according to the decision dated June 19, 2025, the Commercial Court, Department of Administrative Cases, approved the plaintiff\u2019s request, granting a security measure to postpone the enforcement of the ZRRE notice dated June 3, 2025.
