The former CEO of the Kosovo Energy Corporation (KEK), Nagip Krasniqi, and the defendant Isuf Zejna have pleaded not guilty, while Ymer Dragusha has reached an agreement with the Basic Prosecution Office in Pristina to plead guilty, regarding the charge of abuses at KEK.

Krasniqi, Zejna and Dragusha are accused of the criminal offenses of "abuse of official duty or authority", "disclosure of official secrets" and "assistance in the abuse of official duty or authority".

At the start of the initial hearing, the prosecutor of the case, Fikrie Fejzullahu, stated about the agreement reached between the Prosecution and the accused Dragusha for the admission of guilt, which she said was made voluntarily by the accused himself.

According to the prosecutor, Zejnullahu's agreed-upon plea agreement provides for a sentence of 2 years, which will not be executed if the defendant does not commit criminal offenses during this period.

The defense attorney of the accused Ymer Dragusha, Sabrije Krasniqi, claimed that her client's admission of guilt was made voluntarily and without pressure from anyone.

That the accused himself, Ymer Dragusha, has voluntarily and considering the consequences, admitted his guilt for the four criminal offenses charged by the Prosecution.

Subsequently, the presiding judge, Rrahman Beqiri, postponed the announcement of the verdict for the accused, Ymer Dragusha, until the conclusion of this entire criminal case.

After this, the initial review session continued with the reading of the indictment, according to which Nagip Krasniqi in his capacity as the Chief Executive Officer of KEK, Ymer Dragusha in his capacity as the Acting Director of the Procurement Office, and Isuf Zejna, as a representative of the company "Rexhepi Zeqiri Zejna LLC", with their actions caused damage to the state budget of approximately 37 million euros.

The prosecutor in the case, Fikrie Zejnullahu, said that the defendants, Nagip Krasniqi and Ymer Dragusha, with their actions have abused official authority, causing significant damage to the Kosovo budget.

Further, according to the indictment, the former CEO of KEK, Nagip Krasniqi, together with Ymer Dragusha, illegally entered into a harmful contract with the economic operator "Rexhepi Zeqiri Zejna LL.C."

The sixth count of the indictment states that the accused, Nagip Krasniqi, in the period 2022-2023, intentionally and in his capacity as an official person, revealed official secrets regarding the procurement procedures that were being carried out at KEK, sharing them with the unofficial person, namely Dejona Mihali.

According to the indictment, on August 4, 2022, Krasniqi, during communications on the social network "Signal", sent Mihali a request addressed to the Government of the Republic of Kosovo, namely the Prime Minister of Kosovo and the ministers of the Government, to supplement/amend the decision to declare an energy emergency.

While the lawyer, Isuf Zejna, is accused of having, during December 2021 to April 2023, in Pristina, Zejna, as a representative of the company "Rexhepi Zeqiri Zejna LLC", intentionally and for the purpose of personal gain, helped the defendant Krasniqi to abuse his official position in relation to the tender entitled "Engagement of a legal consulting company".

Regarding all the charges against the former CEO of the Kosovo Energy Corporation (KEK), after reading the indictment, he declared himself innocent.

Even the lawyer, Isuf Zejna, did not admit guilt.

The previous initial hearing for the second indictment against the former CEO of the Kosovo Energy Corporation (KEK), Nagip Krasniqi, Ymer Dagusha and Isuf Zejne, accused of abuses at KEK, failed because the accused, Ymer Dragusha, was absent.

Regarding this case, the Basic Prosecution Office of Pristina filed the indictment on December 30, 2024.
