The former judge of the Constitutional Court, Kadri Kryeziu, calls Serbia's attempt for judicial jurisdiction in Kosovo an international legal aggression against an independent and sovereign state.
A few days ago, the Government of Serbia approved a draft law which foresees trials for crimes under the Serbian Criminal Code committed from 2008 onwards. The document has been proposed to the Assembly in Serbia for approval.
Kryeziu tells KosovaPress that "the legal aggression preceded that terrorist attack in Banjska" by Zveçani.
The attack on the Kosovo Police in Banjska of Zveçan took place on September 24 last year, by a group of armed Serbs.
The responsibility for the terrorist attack was taken by the former vice-president of the Serbian List, Millan Radoicic, this party which has the support of official Belgrade.
The former judge of the Constitutional Court emphasizes that legally a legal initiative of Serbia cannot have a legal effect in Kosovo and Albania, but that "the risk exists for applicability from other countries of the Western Balkans".
Kryeziu considers Serbia's decision on this draft law as revenge against the justice system in Kosovo, after the arrest warrants that the authorities in Kosovo have issued for the persons involved in the terrorist attack in Banjska.
In September, one year after the attack, the Special Prosecutor's Office of Kosovo filed an indictment against 45 people.
Among other things, the expert on constitutional issues says that Serbia has undertaken such aggressive and destructive actions with the aim of delaying the issue of dialogue.
Kryeziu claims that Serbia's approach is destructive, and according to him, Kosovo should turn to the international community, especially the United States.
Serbia's decision on these legal actions has prompted reactions from the international factor.
The European Union said that Serbia with this law violates the obligations arising from the dialogue. The United States also agreed with this.
Spokesperson Nabila Massaralli told KosovaPress earlier in the week that "The draft law proposed by the Government of Serbia [to declare Kosovo a special protection zone and for the jurisdiction for the judicial authorities to prosecute criminal offenses in Kosovo] in the way they have been published, present clear violations by Serbia of the obligations from the dialogue and contradict the recently repeated commitment to the dialogue".
Meanwhile, the prime minister of Kosovo, Albin Kurti, has called Serbia's action hostile and aggressive towards the territorial integrity and sovereignty of Kosovo.
