AVONET: The irrational increase in the price of medicines in Kosovo is prevented

The Network of Non-Governmental Organizations AVONET has announced that the Ministry of Health has canceled the decision of the commission appointed by the Ministry itself for setting the prices of medicinal products.

AVONET says that this process comes as a requirement of the Law on the prices of medicinal products, which entered into force on August 18, 2023, where in the provisions of this law, specifically in its article 19, it is provided that the price list of medicines it is published for the first time 4 months after its entry into force, and its implementation begins 6 months after.

However, according to this network of NGOs, the Ministry of Health has been delayed in the implementation of this legal requirement, where only in January of this year it formed the commission for setting the prices of medicinal products.

In this direction, AVONET says that on 15.05.2024 through the decision with no. prot. 05-3676, of the Minister of the Ministry of Health, the proposal of the commission for setting the prices of drugs in the pharmaceutical market of the Republic of Kosovo has been approved.

"AVONET, after the publication of the decision on the official websites of the KAPPM and the Ministry of Health, has analyzed the above-mentioned decision in its entirety, with particular emphasis on the determination of prices for the sale of medicinal products, where we noticed that the commission on the occasion of setting prices has not fully implemented the methodology provided for in the provisions of the relevant law. According to article 8.2 of the Law on the prices of medicinal products, the reference for setting the prices of medicinal products should be the publications of the latest official reports of the time, on the official portals in the networks of the responsible official institutions of these reference countries: Albania, Macedonia North, Montenegro, Croatia and the country of origin of the product. AVONET has reached this conclusion after consulting with experts in the pharmaceutical field and owners of pharmacies operating in the pharmaceutical market of the Republic of Kosovo", says AVONET in the press release.

After this analysis, AVONET says that it has taken concrete steps in the direction of dealing with this issue, where on 21.05.2024, using the provisions of the positive law for access to public documents, it has requested access to all the commission's documents, with the aim the complete analysis of the work of this commission, with special emphasis on the analysis of the method of how they reached the setting of these prices.

"According to our analysis, we see that the prices proposed by the commission and materialized through the decision of the minister of MOH, in most cases are significantly higher than the current prices in the pharmaceutical market in our country. However, on the part of the responsible officials of the MOH, we have encountered negligence in terms of handling within the legal time limit the request for access to public documents, with the sole justification that we are in the process of collecting documentation, where we have not yet received the requested documents".

"Well, dated 07.06.2024 through decision no. prot. 05-4289 of the Minister of the Ministry of Internal Affairs, the decision with no. prot. 05-3676, where the commission for setting the prices of medicinal products was obliged to draw up a new list that should also take into account the instructions given by the complaints commission at the MOH", said AVONET.

The AVONET Network of Non-Governmental Organizations assesses that this is a proper step taken by the Minister of Health, "due to the fact that with this action the general citizen interest is being protected, ensuring a real price according to the market and leveling of prices as a whole, which are also the goals of the Law on setting the prices of medicinal products".
