The Chairman of the Parliamentary Group of the Democratic Party of Kosovo, Abelard Tahiri, announced today that they contested the decision to schedule last week's plenary session in the Constitutional Court.
Tahiri emphasized that the last plenary session (July 13) should be cancelled, as well as all the decisions that were made that day.
"As an authorized party to the Constitutional Court of the Republic of Kosovo, we have submitted the request for the evaluation of the constitutionality of the Decision on the appointment of the Plenary Session of July 13, 2023 of the President of the Assembly of the Republic of Kosovo, with the request that the same be canceled in its entirety . The last plenary session of the Assembly was scheduled and invited in violation of the Constitution of the Republic of Kosovo and the Rules of Procedure of the Assembly, therefore, as such, it must be canceled and all the decisions that were taken in this unconstitutional session . As the submitter of this case, we estimate that the President of the Assembly has committed a constitutional violation in two directions: first, in failing to meet the deadline for calling and scheduling the plenary session and, second, by not setting the agenda for approval this session - in the absence of the consensus of the Presidency as a result of the lack of the necessary quorum, namely the failure to hold the meeting of the Presidency", wrote Tahiri on Facebook.
He added that they requested a temporary measure, until the final decision of the Constitutional Court, to suspend the effect of all the decisions that resulted from the last plenary session.
"As such, this decision has produced constitutional and legal consequences because it resulted in the holding of the invited plenary session according to an unconstitutional procedure, in which laws and draft laws were approved as well as other decisions for the election/dismissal of the bearers of constitutional institutions and independent institutions. In addition to the request for the cancellation of this session and the decisions that were made in it, we also requested a Temporary Measure, so that until the final decision of the Constitutional Court, the effect of all the decisions that resulted from this unconstitutional session should be suspended," he wrote. away he goes.
Meanwhile, the deputy of the Vetëvendosje Movement, Adnan Rrustemi, has stated that PDK is positioned against the citizens of the country. According to him, PDK wants to take revenge on the citizens for the result of the elections of February 14, 2021.
"PDK is clearly against the people of Kosovo. They want to take revenge on the people for the result of the February 14 elections. It is unimaginable to see that this party has sent to the Constitutional Court the decision of the President of the Assembly for last week's session where a number of important decisions were voted," wrote Rrustemi on Facebook.
Otherwise, during the speech of Prime Minister Albin Kurti in the July 13 session, deputies and ministers were involved in a physical fight. The deputy of the Democratic Party of Kosovo in the direction of the floor of the Assembly, Mërgim Lushtaku, has thrown water in the direction of Kurti and Deputy Prime Minister Besnik Bislimi.
