Kica-Xhelili: The Constitutional Court and democracy were not created thanks to Minister Haxhiu

The deputy from the ranks of the Democratic League of Kosovo (LDK), Doarsa Kica-Xjelili, has reacted to the Minister of Justice, Albulena Haxhiu, saying that she has no right to comment on the content of court decisions, much less, according to her, of the Constitutional Court when it overturns Haxhiu's decisions.

Kica - Xjelili, has said that neither the Constitutional Court nor democracy in Kosovo were created thanks to Minister Haxhiu.

"Someone should remind this minister that she is a minister in a DEMOCRATIC state - where powers are separated and I cannot control the judiciary (thankfully for democracy).

Someone needs to remind this minister that she is a minister of JUSTICE – not a constant minister of leftist campaigning. That the rule of law, which she turns into a personal adjective in the campaign, should be an adjective in practice when running an institution.

Someone should remind this minister that I have NO RIGHT to comment on the content of court decisions, let alone the Constitutional Court when it overturns HER decisions. Neither this Court nor this democracy was created thanks to Minister Haxhiu, in fact AT LEAST thanks to the mentality that this majority is showing.

But, she is the minister of this parliamentary democracy and must EITHER respect this democracy, or move to an autocratic state that coincides with her ideology.

And when you remind him of all this, remind him that it is a Recommendation of the Council of Europe that this minister DOESN'T DARE speak the way she speaks and act the way she acts.

Paragraph 18 of the Recommendations of the Council of Europe on the independence of the judiciary [CM/Rec(2010)12]:

"If judges' decisions are commented on, the executive and legislative power must avoid criticism that would undermine the independence or public confidence in the judiciary (…) except for declaring their intention to appeal/appeal."

In the end, I remind you, and maybe a little to myself, that all this (re)remembering about her will be potentially futile.

How many times have I appealed to these recommendations, these standards, and these democratic pillars, she has turned it into a personal one. She, or those who serve her. That's what I expect from her. That's what I expect from them", Xhelili wrote.
