The deputy of the Vetëvendosje Movement, Adnan Rrustemi, says that the constitutional amendments for vetting will be made in the first six months of 2023, while the concrete work of this process will begin in the second half of the year. Rrustemi, who is also the chairman of the Parliamentary Commission for Legislation, emphasizes that at the beginning of the spring session of the Assembly, the draft law on the state bureau for the verification and confiscation of unjustifiable assets will be approved in the second reading.
Rrustemi for KosovaPress, says that in parallel with the goals for constitutional changes for vetting, the option for legal changes will also be worked on.
"I believe that the constitutional amendments should be voted on in the first part of 2023, then the law as well. We can consider that the start of the work will be done in the second half of 2023. Now there are also challenges, of course, since the constitutional amendments require two-thirds of all deputies and two-thirds of the deputies holding reserved seats. But this is a political part, when a broader discussion is needed at later stages, but I believe that a consensus will be created, since vetting is a process in the interest of all citizens, regardless of ethnicity," he says.
Rrustemi says that before the constitutional amendments for vetting are approved, they will go to the Constitutional Court for their preliminary evaluation.
"At the next meeting, we will approve the action plan and start examining the constitutional amendments. As is also required with the procedures for amending the Constitution, taking into account that we are interested in option five, which means through constitutional amendments. We will draft constitutional amendments, before they are approved, the Speaker of the Assembly must send them to the Constitutional Court for a preliminary evaluation of the amendments as to whether they violate the rights provided by the Constitution. After the decision of the Constitutional Court, we expect them to be examined and approved by the Assembly. At the same time, we think of working with the law on the vetting process and any other law that this process involves. We hope that within the six-month period that the Assembly has determined, we will complete this process completely, in the sense of approving the constitutional and legal basis and the start of the troops", declares Rrustemi.
In addition, the deputy of the majority says that with the approval in the second reading of the bureau, the disturbing phenomenon of unjustified enrichment of public officials in Kosovo will be addressed.
"The last opinion of Venice highly appreciates the work that has been done and I would say positively every intervention and address. Of course, he also gave three or four non-essential recommendations that we expect as a committee to address very quickly and to approve the report with amendments to address to the session. Now the Assembly is at the end of the autumn session, I don't know how many sessions we will have this year, but we are ready to proceed as soon as possible. Now it remains for the Presidency of the Assembly to decide whether it will be in the last session for this year, or in the first session of the spring session, but in any case, in the third week of January, we expect the draft law for the bureau to be approved and the establishment of this institution to begin. , as provided by law and to start work on addressing a disturbing phenomenon in our society, which has been the unjustifiable enrichment of public officials in Kosovo", he adds.
According to him, the Venice Commission's comments on this draft law silenced all the concerns of those who opposed the establishment of the state bureau for the verification and confiscation of unjustifiable assets.
"Venice has silenced all the well-founded or ungrounded concerns of everyone who has opposed this draft law, even those who have opposed the review in the Assembly and the requests to withdraw it from the Government. It has been confirmed by the majority that it is good that it has not been withdrawn, as we have assessed that there is room for addressing the recommendations. We are interested in this Draft Law being with the best international standards and practices. Always bearing in mind that civil confiscation is a rare phenomenon, I would say, as is the phenomenon of unjustified enrichment of public officials. There are no more excuses to oppose, unless there are subjective motives", emphasizes Rrustemi.
During the last week, the Ad-hoc Commission was constituted for the development of the transitory assessment process in the Assembly, whose duty will be to administer the entire judicial vetting process.
