For the third time, the Court of Appeals in Rome has ruled that illegal immigrants who have been sent to reception centers in Gjadra and Shëngjin must be returned to Italy.

This decision was taken yesterday (January 31), and forces the deportation of 43 migrants, who are currently in Lezha, after their arrival in Albania on January 29, writes euronews.al.

All these immigrants, who had arrived in Albania the day before, are expected to return to Italy today.

The judges who were tasked with reviewing the immigrants' files have reached a conclusion that expressed a negative opinion towards their return, as foreseen by the procedure approved by the government.

This decision has raised questions about the legality of the authorities' actions and has highlighted disagreements over the treatment of migrants who are scattered across several countries, including Albania, where some of the reception centers are located.

According to the provision signed by the judges, the decision to return the emigrants should be suspended pending a final decision by the Court of Justice.

This court will consider the issue of "safe countries" in a decision expected on February 25, 2025.

This means that the return of these immigrants can be suspended until this date, while the judges have emphasized that the suspension of the decision makes it impossible to meet the 48-hour deadline for its validity, and as a result, it is necessary to order their return.
