“Game” ÇOHU! – ACA has not ended yet

The Municipal Court in Prishtina turned down the charges of the head of ACA, Hasan Preteni, by instructing him to make it civil and not criminal indictment.

The decision of the Municipal Court of Prishtina over the charges of Preteni towards ÇOHU! reads: “The private indictment is turned down and the criminal procedure of private claimant Hasan Preteni against the defendants Lorik Bajrami, Artan Demhasaj and Besnik Boletini is suspended for the offense of insult from the article 187 paragraph 1 and the offense of slander from the article 188 paragraph 1 of KPK, because the actions that are subject of the charges are not criminal actions. The private claimant Hasan Preteni is instructed on the civil contest for realization of the legal request. The expenses of the criminal procedure remain on the budget of this court,” reads the decision of the Municipal Court in Prishtina.

As a reasoning of this decision, the Municipal Court in Prishtina said that the private claimant has exercised the private indictment in this court with the nr. P. 732/12, which was received on 1.03.2012 against the defendants Lorik Bajrami, Artan Demhasaj and Besnik Boletini, for the criminal offense of insult from the article 187 paragraph 1 and slander from the article 188 paragraph 1 of KPK and has proposed to the court to find them guilty and judge them based on law.
